Please read these Terms & Conditions carefully before using Examly. By accessing or using our platform, you agree to be bound by these terms.

1. Acceptance of these terms

By creating an account or using Examly in any way, you agree to these Terms & Conditions. If you do not agree, please do not use the platform. These terms apply to all users — teachers, students, and visitors.

2. Description of the service

Examly is an online exam platform. It allows educators ("Teachers") to create academies, upload multiple-choice questions, and publish tests for their students ("Students") to take via a shareable link. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Eligibility

You must be at least 13 years old to use Examly. By creating an account, you confirm that you meet this requirement. If you are creating an account on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms.

4. Your account

You are responsible for keeping your account secure. Examly uses Google Sign-In — you are responsible for the security of your Google account. You are responsible for all activity that occurs under your account. Notify us immediately at support@examly.io if you suspect unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

5. Content uploaded by Teachers

As a Teacher, you are solely responsible for the questions, explanations, and any other content you upload to Examly. You confirm that: • You own the content or have the rights to use it • The content does not infringe any third-party copyright, trademark, or other intellectual property rights • The content does not contain anything unlawful, offensive, or misleading We reserve the right to remove content that violates these terms, at our sole discretion.

6. Acceptable use

You agree not to: • Use Examly for any unlawful purpose • Upload or share content that is defamatory, abusive, discriminatory, or harmful • Attempt to reverse-engineer, scrape, or disrupt the platform • Impersonate another person or organisation • Use the platform to spam or harass users • Upload content that infringes intellectual property rights Violation of these rules may result in immediate account termination.

7. Intellectual property

All platform code, design, branding, and original content produced by Examly is our intellectual property. You may not copy, reproduce, or distribute it without our written permission. Content you upload (questions, explanations, etc.) remains your intellectual property. By uploading it, you grant Examly a limited licence to store, display, and deliver it to the students in your academy for the purpose of operating the service.

8. Privacy

Your use of Examly is also governed by our Privacy Policy. By using the platform, you consent to the collection and use of your data as described there.

9. Disclaimer of warranties

Examly is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the platform will be error-free, uninterrupted, or suitable for any particular purpose. We are not responsible for the accuracy or quality of content uploaded by Teachers.

10. Limitation of liability

To the fullest extent permitted by law, Examly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform — including but not limited to loss of data, loss of income, or exam-related outcomes. Our total liability to you for any claim arising from your use of Examly shall not exceed the amount you paid us in the 12 months preceding the claim (or ₹500 if you have paid nothing).

11. Termination

You may stop using Examly and request account deletion at any time by contacting support@examly.io. We may suspend or terminate your account if you violate these terms, or if we discontinue the service. On termination, your right to use the platform ceases immediately.

12. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by posting a notice on the platform or sending an email. Continued use of Examly after the effective date of the changes constitutes acceptance.

13. Governing law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Maharashtra, India.
